Raffle Rules

SPRING 2012 HOUSE OF DREAMS CHARITY RAFFLE

ELIGIBILITY
Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be an individual 18 years or older at time of entry purchase. Only one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Entries may be purchased via the Internet, call center, mail or at designated drop-off center(s). The House of Dreams Charity Raffle ("Raffle") is conducted in English (with Spanish speaking representatives available). Ticket confirmation number(s) will be mailed to all purchasers at the billing address provided during the purchase. All email communications, including the email ticket purchase confirmation, will be sent to the email address supplied during the purchase. It is the purchaser’s responsibility to provide a valid, deliverable mailing address and/or email address to Naperville Rotary Charities, Inc. ("NRC"). NRC and its agents, Board, vendors, volunteers and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. NRC’s Board members are not eligible to participate in the Raffle. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Official Raffle rules and regulations.

PRIZE DRAWINGS
Key eligibility and prize drawing dates are as follows:
  • Holiday Drawings
    Winning certificate numbers for the Holiday Drawing Prizes will be announced on January 12, 2012. All entries must be received by 11:59 p.m. (CST) on December 31, 2011 to be eligible for these drawings.

  • Valentines Drawings
    Winning certificate numbers for the Valentines Drawing Prizes will be announced on February 23, 2012. All entries must be received by 11:59 p.m. (CST) on February 08, 2012 to be eligible for these drawings.

  • March Madness Drawings
    Winning certificate numbers for the March Madness Drawing Prizes will be announced on March 29, 2012. All entries must be received by 11:59 p.m. (CST) on March 14, 2012 to be eligible for these drawings.

  • Mother's Day Drawings
    Winning certificate numbers for the Mother's Day Drawing Prizes will be announced on May 24, 2012. All entries must be received by 11:59 p.m. (CST) on May 09, 2012 to be eligible for these drawings.

  • Final Drawings
    Winning certificate numbers for all remaining prizes, including the Grand Prize, will be announced on June 21, 2012. All entries must be received by 11:59 p.m. (CST) on June 06, 2012 to be eligible for these drawings. Prizes with the lowest retail value will be drawn first progressing in order to the Grand Prize. After each draw, the winning certificate number will be returned to the draw for all remaining eligible prize drawings. NRC reserves the right not to accept entries at their discretion and to add additional prizes or drawings at any time.
RETURN AND CANCELLATION POLICY
All requests for ticket or Raffle entry cancellations must be made by 11:59 a.m. (CST) at least three (3) business days prior to date of the first drawing for which the ticket(s) in question is/are eligible for. Furthermore, all purchases of Raffle entries are non-refundable after the noon deadline posted above, or once an entry has been included in any prize draw.

PRIZES
The total number of prizes awarded in the Spring 2012 House of Dreams Charity Raffle shall be dependent on the total number of valid entries received. The chance of a valid single ticket entry winning a prize shall be no less than 1-in-15. To receive a detailed explanation of how the odds are determined and/or calculated, please send a written request with a self-addressed, stamped envelope to the address listed below. Prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value or with the cash equivalent by NRC. The approximate value of all combined prizes is over $1,600,000 MSRP (manufacturer's suggested retail price) and is based on estimated MSRP pricing at the time of prize selection and 40,000 valid Raffle entries received. All MSRP's are rounded to the nearest dollar. No prize is valued at less than $100.00 MSRP. In the event of a winning entry having more than one name, NRC will award the prize to the first name listed on the entry. Records of NRC shall be deemed correct if there is any discrepancy. NRC is not responsible for resolving any disputes that may arise from different individuals listed on a valid Raffle certificate. With proper transfer documents bearing notarized signatures, as required by the Raffle, a prize may be transferred.

The winner of the 1st Ticket Grand Prize ("GPW") is entitled to receive up to $1,000,000 towards the actual construction costs of a dream home built by an active, accredited member of the National Association of Home Builders that is approved by NRC ("Builder") or one of the two cash alternatives detailed in (i) and (ii) below. GPW shall provide NRC with written notice of their selected payout option on or before July 21, 2012. The two cash alternatives available to the GPW are either (i) 20 equal payments of $50,000 to be made annually beginning within 30 days of NRC receiving written notification of this option being selected, which amount shall be payable via an annuity purchased in GPW's name; or (ii) a one time lump sum payment of $700,000. If the dream home is selected, then the GPW must be a party to an enforceable, non-contingent home building agreement with a Builder ("Agreement") within sixty (60) days from the date of the Grand Prize Draw, and construction must be scheduled to commence on or before one hundred eighty (180) days from the date of the Grand Prize Draw, and the GPW must also comply with all terms stated in the Official Raffle Rules. If any of the conditions above are not met, then GPW shall automatically receive the payout option detailed in (ii) herein in full satisfaction of the Grand Prize. If fewer than 40,000 tickets are sold in the 2012 House of Dreams Charity Raffle by 11:59 p.m. (CST) on June 06, 2012, then all applicable drawings will be held as scheduled and all prizes will be awarded as advertised to maintain the 1-in-15 chance to win with the exception of the $1 Million Grand Prize, which shall be reduced by a factor equal to the actual number of tickets sold divided by 40,000 and said factor shall be applied to all payment options available to the GPW. For example, if the total number of valid entries in the 2012 House of Dreams Charity Raffle is 36,000, then the Grand Prize would be equal to 90 percent of the original value for all payment options (e.g. up to $900,000 towards the actual construction costs of a dream home or 20 annual payments of $45,000 or $630,000 lump sum payment). All other rules shall apply as stated.

All vehicles come base model factory equipped and winner(s) are also solely responsible for any and all state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. All vehicles are subject to availability at the automobile dealer selected by NRC and may be substituted with a comparable vehicle by NRC. All vehicle prizes are delivered F.O.B. Naperville, Illinois.

Vacation travel prizes are for two economy round trip tickets from a Chicago airport (Midway or O'Hare) to the destination city and for one double occupancy standard hotel room for six nights in the destination city. All vacation and travel prizes are subject to space and availability. All gratuities, taxes and fees are the responsibility of the winner and each vacation prize has a maximum value of five thousand dollars in total. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, age restrictions, liability waivers, travel documentation and reservation and confirmation procedures. All sports-related prizes are subject to availability. All gratuities, taxes and fees are the responsibility of the winner and each vacation prize has a maximum value of five thousand dollars in total. Winners of a sports-related prize must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable dates, age restrictions, liability waivers and reservation and confirmation procedures. Additional details regarding sports-related prizes are listed below. The Chicago Cubs Rooftop prize includes rooftop tickets for twenty at the Sheffield Baseball Club for one 2012 regular season Chicago Cubs major league baseball game. The Bulls Penthouse Suite prize is for a twenty person Penthouse Suite for 20 with a Classic Menu for one regular season Chicago Bulls NBA basketball game in 2012. Each sports-related prize has a maximum value of five thousand dollars in total. The 2013 NCAA Basketball Finals Tickets prize includes two tickets to the 2013 NCAA Men's Basketball Finals in Atlanta, Georgia, two economy round trip tickets from a Chicago airport (Midway or O'Hare) to Atlanta, Georgia, and one double occupancy standard hotel room for up to two nights in Atlanta, Georgia. The Road Trip with the Chicago Bears prize includes two tickets to a 2012 regular season Chicago Bears football game in the continental United States, two economy round trip tickets from a Chicago airport (Midway or O'Hare) to the destination city, and one double occupancy standard hotel room for up to two nights in the destination city. The Chicago Blackhawks Penthouse Suite prize is for a twenty person Penthouse Suite for 20 with a Classic Menu for one regular season Chicago Blackhawks NHL Hockey game in 2012. All vacation, travel or sports-related prizes must be used by the prizewinner and may not be transferred, sold or otherwise utilized by another party without the express, prior written approval of the NRC.

NOTIFICATION OF WINNERS
All winners will be notified in writing or by phone of the prize won and any requisite procedure to claim the prize. All prizes, excluding vehicles, will be sent to the winner's home address only. Except for the GPW, winners of all prizes shall have forty (45) calendar days from notification of winning, to inform NRC of their choice to take the prize, accept the cash alternative or select any other offered alternatives. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw date of any Raffle drawing, the prize or its cash equivalent will be deemed to have been donated to NRC for use by their charitable foundation. All winners, by entering, authorize NRC to publish their name and likeness on the website and for it to be used in other promotional materials by NRC.

TAXES AND IRS RULES
All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding.

WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers, by participating (and winners, by accepting a prize) release Naperville Rotary Charities, Inc., and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of NRC shall be limited to ticket price paid and in the case of any dispute, NRC's decision shall be final. NRC reserves the right to modify or amend the Official Raffle Rules without notice at any time.
