SPRING 2010 HOD CHARITY RAFFLE
ELIGIBILITY
Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be an individual 18 years or older at time of entry purchase. Only one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Entries may be purchased via the Internet, call center, mail or at designated drop-off center(s). The House of Dreams Charity Raffle ("Raffle") is conducted in English (with Spanish speaking representatives available at the call center). Ticket confirmation number(s) will be mailed to all purchasers at the billing address provided during the purchase. All email communications, including the email ticket purchase confirmation, will be sent to the email address supplied during the purchase. It is the purchaser's responsibility to provide a valid, deliverable mailing address and/or email address to Naperville Rotary Charities, Inc. ("NRC"). NRC and its agents, Board, vendors, volunteers and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. NRC's Board members are not eligible to participate in the Raffle. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Official Raffle rules and regulations. PRIZE DRAWINGS A maximum of 40,000 entries will be sold for the 2010 Spring House of Dreams Charity Raffle. Key eligibility and prize drawing dates are as follows:
Up to 3,172 prizes will be awarded in the Spring 2010 House of Dreams Charity Raffle. The total number of prizes awarded shall be dependent on the number of valid entries received. The chance of a valid single ticket entry winning a prize shall be no less than 1-in-15 based on the total number of valid entries received for the Raffle. To receive a detailed explanation of how the odds are determined and/or calculated, please send a written request with a self-addressed, stamped envelope to the address listed below. Prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value or with the cash equivalent by NRC. The approximate value of all combined prizes is over $1,600,000 MSRP (manufacturer's suggested retail price) and is based on estimated MSRP pricing at the time of prize selection. All MSRP's are rounded to the nearest dollar. No prize is valued at less than $100.00 MSRP. In the event of a winning entry having more than one name, NRC will award the prize to the first name listed on the entry. Records of NRC shall be deemed correct if there is any discrepancy. NRC is not responsible for resolving any disputes that may arise from different individuals listed on a valid Raffle certificate. With proper transfer documents bearing notarized signatures, as required by the Raffle, a prize may be transferred. The winner of the 1st Ticket Grand Prize ("GPW") is entitled to receive up to $1,000,000 for the actual construction costs of a dream home built by an active, accredited member of the National Association of Home Builders that is approved by NRC ("Builder") or one of the cash alternatives detailed in (i) and (ii) below. Within 30 days of notification by NRC, GPW may select one of the cash alternatives by providing NRC with written notification of the cash alternative selected which is either: (i) the payment of the $1,000,000 cash prize via twenty (20) equal, annual payments of $50,000 with first payment made within thirty (30) days following NRC's receipt of GPW's written notification of acceptance of this option and the remaining nineteen (19) payments of $50,000 made annually on the anniversary date that the first payment was made; or (ii) a one-time lump sum payment of $700,000 in cash within thirty (30) days of NRC's receipt of GPW's written notification of acceptance of this option (ii). If the dream home is selected, then the GPW must be a party to an enforceable, non-contingent home building agreement with a Builder ("Agreement") within sixty (60) days from the date of the Grand Prize Draw, and construction must be scheduled to commence on or before one hundred eighty (180) days from the date of the Grand Prize Draw, and the GPW must also comply with all terms stated in the Official Raffle Rules. If these conditions are not met, then GPW shall automatically receive the one-time lump sum cash payment stated in (ii) herein in full satisfaction of the Grand Prize. If fewer than 22,000 total tickets are sold by 11:59 p.m. (CST) on June 9, 2010, then all applicable drawings will be held as scheduled and all prizes will be awarded as advertised with the exception of the $1 Million Grand Prize which shall be reduced by a factor equal to the actual number of tickets sold divided by 22,000 and said factor shall be applied to all payment options available to the GPW. For example, if 19,800 tickets are sold, the Grand Prize would be reduced to 90% (19,800/22,000) of the original value for all payment options (i.e., up to $900,000 for the actual construction costs of a dream home, 20 annual payments of $45,000, or a $630,000 lump sum payment). All other rules shall apply as stated. All automobiles, trucks, boats, watercraft and motorcycles ("vehicles") come base model factory equipped and winner(s) are also solely responsible for any and all state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to possession) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. All vehicles are subject to availability at the automobile dealer selected by NRC and may be substituted with a comparable vehicle by NRC. All vehicle prizes are delivered F.O.B. Naperville, Illinois. Vacation and travel prizes are based on space and availability and all gratuities, taxes and fees are responsibility of winner. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, travel documentation and reservation and confirmation procedures. RETURN AND CANCELLATION POLICY All requests for ticket or Raffle entry cancellations must be made by 11:59 a.m. (CST) at least three (3) business days prior to date of the first drawing for which the ticket(s) in question is/are eligible for. Furthermore, all purchases of Raffle entries are non-refundable after the noon deadline posted above, or once an entry has been included in any prize draw. NOTIFICATION OF WINNERS All winners will be notified in writing or by phone of the prize won and any requisite procedure to claim the prize. All prizes, excluding vehicles, will be sent to the winner's home address only. Except for the GPW, winners of all prizes shall have forty (45) calendar days from notification of winning, to inform NRC of their choice to take the prize, accept the cash alternative or select any other offered alternatives. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw date of any Raffle drawing, the prize or its cash equivalent will be deemed to have been donated to NRC for use by their charitable foundation. All winners, by entering, authorize NRC to publish their name and likeness on the website and for it to be used in other promotional materials by NRC. TAXES AND IRS RULES All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding. WAIVER/LIMITATIONS OF LIABILITY Entry purchasers, by participating (and winners, by accepting a prize) release Naperville Rotary Charities, Inc., and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of NRC shall be limited to ticket price paid and in the case of any dispute, NRC's decision shall be final. NRC reserves the right to modify or amend the Official Raffle Rules without notice at any time.
