Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be an individual 18 years or older at time of entry purchase. Only one (1) individual may be identified as the purchaser (or buyer) of the raffle entry. All federal, state and local laws and regulations apply. Entries may be purchased via the Internet, mail or at designated drop-off center(s). The House of Dreams Charity Raffle ("Raffle") is conducted in English (with Spanish speaking representatives available). Ticket confirmation number(s) will be mailed to all purchasers at the billing address provided during the purchase. All email communications, including the email ticket purchase confirmation, will be sent to the email address supplied during the purchase. It is the purchaser’s responsibility to provide a valid, deliverable mailing address and/or email address to Naperville Rotary Charities, Inc.
("NRC"). NRC and its agents, Board, vendors, volunteers and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. NRC’s Board members are not eligible to participate in the Raffle. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Official Raffle rules and regulations.
Key eligibility and prize drawing dates are as follows:
Winning certificate numbers for the Holiday Drawing Prizes will be announced on January 15, 2015. All entries must be received by 11:59 p.m. (CST) on December 31, 2014 to be eligible for these drawings.
Winning certificate numbers for the Customer Appreciation Prizes will be announced on February 19, 2015. All entries must be received by 11:59 p.m. (CST) on February 06, 2015 to be eligible for these drawings.
Winning certificate numbers for the Early Bird Prizes will be announced on March 26, 2015. All entries must be received by 11:59 p.m. (CST) on March 13, 2015 to be eligible for these drawings.
Winning certificate numbers for the Spring Bonus Prizes will be announced on April 30, 2015. All entries must be received by 11:59 p.m. (CST) on April 17, 2015 to be eligible for these drawings.
Winning certificate numbers for all remaining prizes, including the Grand Prize, will be announced on May 28, 2015. All entries must be received by 11:59 p.m. (CST) on May 15, 2015 to be eligible for these drawings. Prizes with the lowest retail value will be drawn first progressing in order to the Grand Prize. After each draw, the winning certificate number will be returned to the draw for all remaining eligible prize drawings.
NRC reserves the right to accept or reject any raffle entry, modify or extend prize drawing deadlines, and/or add additional prizes or drawings at any time, in their sole discretion.
RETURN AND CANCELLATION POLICY
All requests for ticket or Raffle entry cancellations must be made by 11:59 a.m. (CST) at least three (3) business days prior to date of the first drawing for which the ticket(s) in question is/are eligible for. Furthermore, all purchases of Raffle entries are non-refundable after the noon deadline posted above, or once an entry has been included in any prize draw.
The total number of prizes awarded in the Spring 2015 House of Dreams Charity Raffle shall be dependent on the total number of valid entries received. Prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value or with the cash equivalent by NRC. The approximate cumulative value of all available prizes is over $1,300,000 manufacturer’s suggested retail price (“MSRP”) and is based on estimated MSRP pricing at the time of prize selection and 50,000 valid Raffle entries received. All MSRP’s are rounded to the nearest dollar. No prize is valued at less than $100.00 MSRP as of December 01, 2014. In the event of a winning entry having more than one name, NRC will award the prize to the first name listed on the entry. Records of NRC shall be deemed correct if there is any discrepancy. NRC is not responsible for resolving any disputes that may arise from different individuals listed on a valid Raffle certificate. With proper transfer documents bearing notarized signatures, as required by the Raffle, a prize may be transferred. 5th Ticket prizes for all drawings, except the Grand Prize Drawing, shall only be applicable to a purchaser’s 5th ticket, provided that said 5th ticket is valid and is determined by the NRC to have been purchased prior to the applicable drawing deadline. 2nd Ticket prizes for all drawings, except the Grand Prize Drawing, shall only be applicable to a purchaser’s 2nd ticket, provided that said 2nd ticket is valid and is determined by the NRC to have been purchased prior to the applicable drawing deadline.
The winner of the 1st Ticket Grand Prize (“Grand Prize”) is entitled to receive up to $1,000,000 towards the actual construction costs of a dream home built by an active, accredited member of the National Association of Home Builders that is approved by NRC (“Builder”) or one of the two cash alternatives detailed in (i) and (ii) below. The Grand Prize winner shall provide NRC with written notice of their selected payout option on or before July 19, 2015. The two cash alternatives available to the Grand Prize winner are (i) the payment of the Grand Prize via twenty (20) equal payments that are each equivalent to five (5%) percent of the Grand Prize amount awarded pursuant to these rules, which payments will be made annually beginning with the first payment made within 30 days of NRC receiving written notification of this option being selected, and shall be payable via an annuity purchased in the Grand Prize winner’s name; or (ii) a one-time lump sum cash payment equal to seventy (70%) percent of the Grand Prize amount awarded pursuant to these rules. If the dream home is selected, then the Grand Prize winner must be a party to an enforceable, non-contingent home building agreement with a Builder (“Agreement”) within sixty (60) days from the date of the Grand Prize Drawing, and construction must be scheduled to commence on or before one hundred eighty (180) days from the date of the Grand Prize Drawing. The Grand Prize winner must also comply with all terms stated in the Official Raffle Rules. If any of the conditions above are not met, then the Grand Prize winner shall automatically receive the payout option detailed in (ii) herein in full satisfaction of the Grand Prize. If 50,000 tickets are sold in the 2015 House of Dreams Charity Raffle by 11:59 p.m. (CST) on May 15, 2015, then all applicable drawings will be held as scheduled and all prizes will be awarded as advertised. In the case of under 50,000 tickets being sold in the 2015 House of Dreams Charity Raffle by the aforementioned deadline, the Grand Prize amount awarded to the Grand Prize winner of the 2015 House of Dreams Charity Raffle shall equal the greater of $100,000 or fifty (50%) percent of the Net Proceeds from the 2015 House of Dreams Charity Raffle (“Net Proceeds”). The Net Proceeds shall be determined by NRC’s certified public accounting firm on or before August 31, 2015, and their determination shall be final and binding. All other rules shall apply as stated including, without limitation, the application, payment and timing of the available cash alternatives as stated in (i) and (ii) herein relative to the Grand Prize.
All vehicles prizes come base model factory equipped and winner(s) are also solely responsible for any and all state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. All vehicles are subject to availability at the automobile dealer selected by NRC and may be substituted with a comparable vehicle by NRC in their sole discretion. All vehicle prizes are delivered F.O.B. Naperville, Illinois.
Vacation and travel prizes are for two economy round trip tickets from a Chicago airport (Midway or O’Hare) to the destination city and for one double occupancy standard hotel room for up to six nights in the destination city. All vacation and travel prizes are subject to space and availability. All gratuities, taxes and fees are the responsibility of the winner and each vacation prize has a maximum cash value of five thousand dollars in total. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, age restrictions, liability waivers, travel documentation and reservation and confirmation procedures. All vacation prizes must be used by the prizewinner and may not be transferred, sold or otherwise utilized by another party without the express, prior written approval of the NRC.
NOTIFICATION OF WINNERS
All winners will be notified in writing or by phone of the prize won and any requisite procedure to claim the prize. All prizes, excluding vehicles, will be sent to the winner’s home address only. Except for the GPW, winners of all prizes shall have forty-five (45) calendar days from notification of winning, to inform NRC of their choice to take the prize, accept the cash alternative or select any other offered alternatives. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw date of any Raffle drawing, the prize or its cash equivalent will be deemed to have been donated to NRC for use by their charitable foundation. All winners, by entering, authorize NRC to publish their name and likeness on the website and for it to be used in other promotional materials by NRC.
TAXES AND IRS RULES
All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding.
WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers, by participating (and winners, by accepting a prize) release Naperville Rotary Charities, Inc., and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of NRC shall be limited to ticket price paid and in the case of any dispute; NRC’s decision shall be final. NRC reserves the right to modify or amend the Official Raffle Rules without notice at any time.
